Applying for EB-1B
The process for applying for EB-1B, Outstanding Professors and Researchers, involves two steps:
1.听 File I-140, Immigration Petition for Alien Workers.听 To file I-140 with USCIS. 兔子先生传媒文化作品 must demonstrate the following:
补.听听The foreign national is internationally recognized for their outstanding achievement within the academic field.听 To demonstrate international recognition, they must satisfy at least 2, but preferably more, of the following criteria:
颈.听听Documentation of the individual鈥檚 receipt of major prizes or awards for outstanding achievement in the academic field;
i颈.听听Documentation of the individual鈥檚 membership in associations in the academic field which require outstanding achievements of their members;
ii颈.听听Published material in professional publications written by others about the individual鈥檚 work in the academic field. Such material shall include the title, date, and author of the material, and any necessary translation;
颈惫.听听Evidence of the individual鈥檚 participation, either individually or on a panel, as the judge of the work of others in the same or an allied academic field;
惫.听听Evidence of the individual鈥檚 original scientific or scholarly research contributions to the academic field;
v颈.听听Evidence of the individual鈥檚 authorship of scholarly books or articles (in scholarly journals with international circulation) in the academic field.
产.听听They have 3 years鈥� experience in teaching or research.
肠.听听听They have been offered a tenure track听or comparable research position at the university.
Standard of Review by USCIS for EB-1B
USCIS will conduct a "final merit determination" to decide whether a foreign national is 鈥渙utstanding.鈥澨� The types of evidence listed above serve only as guidelines for the USCIS adjudicator and petitioner (兔子先生传媒文化作品).听 The evidence provided to USCIS must establish that the beneficiary is a researcher or professor who is internationally recognized as outstanding.听 Just presenting evidence that relates to two of the listed criteria does not indicate that the petition will be approved.
The I-140 petition typically involves the foreign national preparing a personal statement addressing the criteria above, detailed letters from experts and independent authors in the field attesting to the foreign national鈥檚 satisfaction of the criteria above, and evidence demonstrating how the foreign national satisfies the criteria above.
2.听 Filing the I-485, Application to Register Permanent Residence or Adjust Status (green card application) with USCIS:
