A.听 Academic Success Policy Statement

The Academic Success and Engagement Division at the University of Toledo provides short message service (鈥楽MS鈥 or 鈥渢ext messaging鈥) communication, and collaboration services to support academic, research, medical, and administrative functions of the institution. University SMS communication services are to be used responsibly within the normal standards of professional and personal courtesy and conduct. The use of SMS communication services is a privilege, not a right, and it should be treated as such by all users.

Academic Success and Engagement values student preferences in receiving information and will use short message service (鈥楽MS鈥 or 鈥渢ext messaging鈥) communication, efficiently while protecting personal data, respecting privacy, and complying with applicable laws such as the Telephone Consumer Protection Act (TCPA).

B.听 Scope

This policy governs the use of the Navigate 360 text messaging systems for all related non-emergency text communications. According to Ohio law, electronic communications such as SMS messages are generally considered to be public records to an equal degree of equivalent communication in physical form. SMS communications written and sent during university business are subject to applicable provisions of this policy, regardless of whether the communication was sent or received on a public or privately owned personal device or messaging system.

It does not apply to emergency communications through the UT alert system.

C.听 Policy

SMS communication must comply with these general principles and rules:

1. Authorized Use

    1. Only authorized university offices and personnel may use university text messaging systems.
    2. All non-emergency messages must be reviewed and approved.
    3. Each mass text message much include identifier showing the sending office or department.

2. Data and Privacy Requirements

    1. Individuals must opt in to receive non-emergency text messages.
    2. Recipient information must remain secure and confidential at all times.
    3. Messages must not contain confidential or restricted data.
    4. Opt-out instructions (鈥淭ext STOP to end鈥) must be included in all communications.

3. Opt-In Language

The following language or similar is required to be listed where individuals elect to opt in to receive non-emergency SMS communication:

By opting in, you are consenting to receiving text messages about appointments, enrollment, student accounts, and more from 兔子先生传媒文化作品 and its representatives at the phone number entered and agree that these communications may be delivered using an electronic SMS communication system.

4. Message Standards

    1. Messages must be timely, valid, and relevant to the audience.
    2. Messages should be limited to 160 characters and sent during regular business hours.
    3. URLS must be shortened and clearly connected to the University.
    4. Text messaging must supplement, not replace, other forms for communication.

5. Responsibilities

    1. Departments must submit a communications plan to University Relations outlining:
      1. Target audience
      2. Purpose and frequency of messages
      3. Responsible personnel
    2. Each major department must designate a texting liaison trained in system use and accessibility.
    3. Liaisons must participate in regular reviews with University compliance, track message activity, and ensure ADA accessibility in communications.

6. Management of SMS communication systems

Access to the university SMS communication systems, when provided, is a privilege that may be wholly or partially restricted by the university without prior notice and without the consent of the user. Individual SMS privileges may be suspended or revoked as conditions warrant to ensure the overall health and security of the university鈥檚 messaging system.

7. Privacy and Confidentiality

The confidentiality and privacy of SMS messages cannot be guaranteed. Disclosure of SMS messages may be made at any time due to legal discovery, public record requests, or other legal request. Authorized users should review the content and attachments of SMS message to ensure that the message would not be a source of embarrassment to the sender, to the recipient, or to the university.

Authorized users should exercise extreme caution when using SMS messaging services to communicate confidential or sensitive matters.

8. Application of Ohio public records law to SMS messaging

The Ohio Public Records Act, and section 149.43 of the Revised Code governs availability of public records. The Ohio Public Records Act treats electronic records (including SMS communication) in the same manner as an equivalent paper record.

Electronic messages that document the functions, policies, and procedures of the university are public records that must be retained in either paper or electronic format. Disposition decisions regarding individual documents should be made in accordance with the definition of public records and in accordance with university record retention policy.

9. Retention

University records in electronic form including documents, email, and backup copies should be retained in accordance with the university's record retention schedules that apply to non-electronic records of similar subject and content. If necessary, specific departmental retention schedules for unique records in electronic form can be established. The university archivist is responsible for establishing records retention schedules. 10. Sensitive data

SMS communications may not contain sensitive data, including PHI, PII, PCI, and student educational records.

11. Prohibited activities

The following practices are prohibited on university SMS communication systems:

    1. Harassment, intimidation, or threatening another person;
    2. Accessing or distributing obscene, sexually explicit, or abusive materials, including but not limited to racial slurs, insensitive gender-related comments or any comment or other material that would offend someone on the basis of his or her age, sexual orientation, religious or political beliefs, national origin, disability or other protected class;
    3. Illegally distributing copyrighted materials;
    4. Initiating or forwarding chain messages;
    5. Pursuing personal business interests not related to the university;
    6. Any purpose that is illegal, against policy, or against the university mission;
    7. Deliberately sending large volumes of mail or attachments to purposely waste resources;
    8. Selling or soliciting the purchase of personal items;
    9. Obtaining access to the electronic communications of others for the purpose of satisfying idle curiosity, with no substantial university purpose;
    10. Attempt unauthorized access to electronic communications or attempt to breach any security measures on any communications system, or attempt to intercept any e-mail or other electronic transmissions without proper authorization; and
    11. Employing false identities or unauthorized

12. Violations

Violations of this policy will be subject to the university鈥檚 disciplinary process and may result in disciplinary action up to and including termination. Minor violations will result in removal of the offending device from the university network at the discretion of information technology or administration. Criminal activity subject to applicable state and federal criminal penalties may be referred to law enforcement as appropriate.

D.听 Definitions

    1. Emergency Notifications: Messages about crises, emergencies, or threats to public safety issued by Campus Safety through the University-approved emergency notification system.
    2. Mass Text Messaging: Non-emergency messaging that includes notifications and information from authorized offices sent to predetermined groups of recipients who have opted in.
    3. University SMS Communication Service(s): SMS or Text messaging platforms approved by the University鈥檚 Information Technology Division.
